Review the example in , where Victor shoots into a crowd of subway travelers and kills Monica. Change the example, and imagine that the subway train has only three passengers. Victor easily shoots in between them, yet the bullet ricochets off one of the seats and strikes Monica, killing her. Victor would be acting with reckless rather than knowing intent in this situation. Victor’s knowledge and awareness of the riskof injury or death when shooting a gun inside a subway car containing three passengers is probably substantial. A reasonable, law-abiding person would probably nottake this action under these circumstances.
