As stated previously, disorderly conduct is a low-level offense that is typically graded as a misdemeanor. 1 The Model Penal Code grades disorderly conduct as a petty misdemeanor if the defendant’s purpose is to cause substantial harm or serious inconvenience or if the defendant persists with his or her conduct after a warning. Otherwise, the Model Penal Code grades disorderly conduct as a violation (Model Penal Code § 250.2(2)).
