The “Admission” Exception

This exception arises—reasonably enough—when the party against whom enforcement is sought admits in testimony or legal papers that a contract was in fact made. 1 However, the admission will not permit enforcement of all claimed terms of the contract; enforcement is limited to the quantity of goods admitted.
